Can Maintenance Income Count Towards a Mortgage After Divorce?

Understand how maintenance income may affect mortgage affordability after separation, what evidence to prepare and how a mortgage capacity report can help.

3 min read

Maintenance payments may form part of a mortgage affordability assessment after divorce or separation, but the treatment depends on the lender and the evidence. Before planning a purchase or taking over the family mortgage, distinguish payments you already receive from payments that are only proposed.

Can child or spousal maintenance be used as mortgage income?

Some lenders consider maintenance income, subject to their criteria. The amount accepted, evidence required and assessment of how long payments will continue can differ. Receiving a payment does not mean every lender will use it, and maintenance alone does not determine what you can borrow.

A mortgage assessment also considers other income, regular commitments, dependants, the deposit or equity, the property and the requested term. Tell your adviser whether maintenance is paid for a child or former partner, how it is arranged and when the arrangement may change.

Evidence of payments matters

Prepare the documents that explain the arrangement and bank statements showing payments received. Identify any difference between the agreed amount and the amount actually received, including missed or varying payments. Your adviser will confirm the selected lender’s requirements.

For an example of lender-specific treatment, Nationwide’s published intermediary criteria, checked on 18 October 2026, require three months of bank-statement evidence and payments received for at least three months. Where amounts differ, its published approach uses the lowest figure for affordability. This is an example of one lender’s criteria, not a recommendation or a rule for the whole market; additional conditions apply and criteria can change.

Proposed maintenance is different from established income

If financial arrangements are still being negotiated, label maintenance as proposed. Explain the assumptions separately for each scenario rather than treating a hoped-for payment as a settled fact. A mortgage capacity report can explore agreed scenarios, but it cannot guarantee that a lender will accept future income.

Ask your solicitor to advise on the legal arrangement and any supporting documents. Mortgage advice addresses the borrowing implications; it does not decide what maintenance should be agreed or how a settlement should be divided.

Keeping the family home or buying elsewhere

If you hope to retain the family home, establish the current mortgage balance and any proposed payment to the other party. The lender must agree to any release of a borrower and assess the borrowing it is asked to provide. An agreement between former partners does not, by itself, remove either person from a joint mortgage.

If you plan to buy another home, separate your available deposit from legal fees, moving costs and any cash reserve. Keep the purchase budget and monthly affordability discussion connected: a larger deposit does not necessarily resolve an income shortfall.

A practical checklist for your adviser

  • State whether payments are child maintenance, spousal maintenance or a combination.

  • Bring the relevant agreement or documentation and the payment history available.

  • Identify confirmed figures, disputed figures and future proposals separately.

  • Explain any expected change in payments, working hours, childcare or other commitments.

  • Provide details of the existing mortgage, debts, savings and expected equity.

  • Give your solicitor’s questions and deadline if a report is required.

What if you pay maintenance?

Declare regular maintenance payments as part of your commitments. Do not deduct a figure from your income and assume that captures the lender’s calculation. Give your adviser both the income and outgoing details so the lender’s assessment can be completed accurately.

Frequently asked questions

  • Some lenders consider maintenance income, subject to their evidence and eligibility requirements. The amount accepted varies, and your wider income, commitments, deposit and property are also assessed.

  • No. A mortgage capacity report can explore agreed scenarios and assumptions, but proposed maintenance must be clearly identified and a lender must assess the eventual application separately.
